Title on new construction

New construction brings title questions a resale usually doesn’t. The biggest one is who has been paid.

  • Lien rights. In Tennessee, contractors, subcontractors, and suppliers who improve a property and aren’t paid can have lien rights against it. A notice of lien generally must be recorded within 90 days after the improvement is completed or abandoned.
  • Proof of payment. Because of those lien rights, title companies commonly ask for lien waivers or an owner’s or contractor’s affidavit before closing, so the buyer’s and lender’s policies can be issued without a lien exception.
  • Matching descriptions. New lots are created by a recorded plat. The deed, the survey, and the title policy all need to describe the lot the same way the plat does.

Getting those pieces lined up early is what keeps a closing date from slipping.
