Closing Disclosure timing
Under the TILA-RESPA Integrated Disclosure (TRID) rule, the borrower must receive the Loan Estimate within three business days of application and the Closing Disclosure at least three business days before consummation. For the Closing Disclosure, a business day is every day except Sundays and federal legal holidays.
A corrected disclosure restarts the three-day wait only when the APR becomes inaccurate beyond the allowed tolerance, the loan product changes, or a prepayment penalty is added. Other changes still call for a corrected disclosure at or before closing, but not a new waiting period. Early, accurate settlement figures give everyone room to stay on schedule.
How a title agent protects the lender
- The lender’s title policy. It protects the lender’s lien up to the loan amount against covered title problems that existed before the loan closed.
- Closing protection letters. Issued by the title insurer, usually to the lender, a closing protection letter covers certain losses caused by the closing agent — such as not following written closing instructions, or fraud in handling funds or documents.
- ALTA Best Practices. The American Land Title Association’s framework sets standards in seven areas: licensing, escrow trust accounting, protecting nonpublic personal information, settlement procedures, title policy production, insurance coverage, and consumer complaints.
